Christian Cuellar, Esq. is the only attorney on the Yucatán Peninsula who holds a master's in Mexican federal taxation and a second master's in U.S. taxation. Twenty years across both systems, including years at leading Southern California firms before returning to the Caribbean coast. Questions we get every week
Do I owe Mexican tax if I work remotely from here?
If you live in Mexico, your physical presence can make you a tax resident regardless of where your clients or your pension are. It turns on where your home and your centre of vital interests are, not only on a day count.
Can a foreigner own beachfront property in Mexico?
Yes, but not directly. Within 50 km of the coast and 100 km of the borders you hold it through a bank trust (fideicomiso) or a Mexican company. Which one is right depends on whether you will rent it out.
What is a fideicomiso and do I need one?
A trust arrangement with a Mexican bank: the bank holds title, you hold every right of use, lease, remodelling and sale. It suits a home you use personally. It is a poor fit for an active rental business.
I want to rent on Airbnb. What do I actually need?
Vacation rental is a business activity. It needs the right land use, a tax registration, an operating licence in most municipalities of Quintana Roo, and monthly filings.
Do you work in English?
Yes. Every matter is handled in English or Spanish, whichever you prefer.
